LAWSUITS FILED FOR ALLEGED HIPAA AND HITECH ACT VIOLATIONS

60 hospitals were named in a lawsuit alleging hitech act violations from 2016, which seeks more than $1 billion in damages. These hospitals received HITECH Act meaningful use incentive payments for transitioning to electronic health records, yet failed to meet the requirement of the HITECH Act with respect to providing patients, and their legal representatives, with copies of health records promptly on request. The HIPAA breach comes from a patient at Barnes-Jewish Hospital in St. Louis, MO who claims the BJC Health System allowed unauthorized individuals to gain access to the protected health information of patients and failed to adequately protect patient data.
